 RCIC Responsibilities and Commitment

The Client(s) asked the RCIC, and the RCIC has agreed, to act for the Client(s) in the matter of

In consideration of the fees paid and the matter stated above, the RCIC agrees to do the following:

  1. PROTECT THE CLIENT’S PRIVACY AND TREAT ALL INFORMATION PROVIDED AS STRICTLY CONFIDENTIAL.
  2. DILIGENTLY PROVIDE PROFESSIONAL IMMIGRATION CONSULTATION AND REPRESENTATION SERVICES REASONABLY REQUIRED TO FULLY REPRESENT AND PROTECT CLIENT’S INTERESTS
  3. TAKE REASONABLE STEPS TO KEEP CLIENT INFORMED OF THE PROGRESS OF ALL MATTERS RELATED TO THE CLIENT’S CASE
  4. RESPOND TO THE CLIENT’S INQUIRIES IN A TIMELY MANNER         
  1. Client(s) Responsibilities and Commitment

The Client(s) must provide, upon request from the RCIC:

  • All necessary documentation

THE CLIENT(S) ACKNOWLEDGES THAT THE IMMIGRATION PROCEDURE DEMANDS AND EXPECTS THE TIMELY SUBMISSION OF DOCUMENTS, INFORMATION AND RESPONSE TO COMMUNICATION BY “CANADIAN MIGRATION INSTITUTE INC. ”  OR THE RELEVANT CANADIAN AUTHORITIES. ANY DELAY OR DELAYS CAN ONLY JEOPARDIZE THE IMMIGRATION PROCESS AND/OR CAUSE UNNECESSARY DELAYS. THEREFORE, THE CLIENT ACCEPTS IT IS CLIENT’S RESPONSIBILITY TO COLLECT ALL REQUIRED DOCUMENTS AND INFORMATION FOR SUBMISSION TO THE CANADIAN AUTHORITIES ACCORDING TO THE INSTRUCTIONS AND/OR CHECKLIST PROVIDED BY “CANADIAN MIGRATION INSTITUTE INC.” WITHIN REASONABLE TIME PERIOD. THE CLIENT WILL NOT HOLD “CANADIAN MIGRATION INSTITUTE INC.” RESPONSIBLE FOR ANY DELAYS, DEFERMENTS OR REJECTION OF CLIENT’S APPLICATION CAUSED BY CLIENT PROVIDING INSUFFICIENT OR INAPPROPRIATE INFORMATION OR DOCUMENTS OR IN THE CASE OF LATE OR DELAYED ACTION OR COMMUNICATION ON MY PART.

 

  • All documentation in English or French, or with an English or French translation
  • Travel

 

THE CLIENT(S) ACKNOWLEDGES AND ACCEPT THAT THE IMMIGRATION PROCEDURE MAY REQUIRE THAT THE CLIENT ALONG WITH CLIENT’S FAMILY MEMBERS TRAVEL AND APPEAR FOR PERSONAL INTERVIEW (S). IN SUCH CASE IT IS CLIENT’S RESPONSIBILITY TO MAKE ALL TRAVEL ARRANGEMENTS AND BEAR ANY RELATED COSTS TO ENSURE CLIENT COMPLIES WITH THE REQUIREMENT TO APPEAR FOR SAID INTERVIEW. THE CLIENT WILL NOT HOLD “CANADIAN MIGRATION INSTITUTE INC.” RESPONSIBLE IF CLIENT’S CASE IS DELAYED OR REJECTED AS A RESULT OF CLIENT OR CLIENT’S FAMILY’S INABILITY TO APPEAR FOR SAID INTERVIEW (S)

 

 

The members obligations under the Retainer Agreement are null and void if the Client(s) knowingly provide(s) any inaccurate, misleading or false material information.  The clients financial obligations remain.

  1. Billing method

The Client(s) will be billed by hours with an hourly rate of $375CAD and payment due upon invoice.

The details of this billing method are as follows:

Client will receive a bill via email sent by CANADIAN MIGRATION INSTITUTE Inc. with details of payment amount, due date and methods of payment.

The above amount is to be paid by the Client(s) and is subject to change upon mutual agreement of both parties.

 

  1. Payment Schedule

Payable upon receiving invoicing online.

ANY FEE PAID AS PER THIS SCHEDULE IS CONSIDERED EARNED BY CANADIAN MIGRATION INSTITUTE INC.

In addition to this process time, there is incubator application which will take an estimated 3-6 months.

  1. Refund Policy

 

The Client(s) acknowledge that the granting of a visa or status and the time required for processing this application is at the sole discretion of the government and not the RCIC. There will be no refund if the government(s) decides to deny the client’s application or change the law during the process.

The RCIC is covered by error and omission insurance, which is renewed every year, If, however, the application is denied because of an error or omission on the part of the RCIC, the clients may be covered by the terms of the error and omission insurance policy. (Certificate of insurance enclosed)

 

 

  1. Dispute Resolution

Please be advised that NI FANG is a member in good standing of The College of Immigration and Citizenship Consultants (CICC), and as such, is bound by its By-laws, Code of Professional Ethics, and associated Regulations. The client acknowledge that a copy of the Code of Professional Conduct for College of Immigration and Citizenship Consultants Licensees: SOR/2022-128 has been provided to the client with the following link: https://www.gazette.gc.ca/rp-pr/p2/2022/2022-06-22/html/sor-dors128-eng.html.

In the event of a dispute, the Client(s) and RCIC are to make every effort to resolve the matter between the two parties.  In the event a resolution cannot be reached, the Client(s) are to present the complaint in writing to the RCIC and allow the RCIC _____60______ days to respond to the Client(s).  In the event the dispute is still unresolved, the Client(s) may follow the complaint and discipline procedure outlined by CICC on their website: https://college-ic.ca/protecting-the-public/complaints-process   NOTE:  All complaint forms must be signed.

  1. Confidentiality

All information and documentation reviewed by the RCIC, required by CIC and all other governing bodies, and used for the preparation of the application will not be divulged to any third party, other than agents and employees, without prior consent, except as demanded by law.  The RCIC, and all agents and employees of the RCIC, are also bound by the confidentiality requirements of Article 8.1 and 8.5 of the Code of Professional Ethics.

 

 

The Client(s) agrees to the use of electronic communication and storage of confidential information.  The RCIC will use his/her best efforts to maintain a high degree of security for electronic communication and information storage.

 

  1. No Guarantee

THE CLIENT(S) ACKNOWLEDGES THAT THE FEES PAID BY THE CLIENT(S) ARE IN CONSIDERATION OF  CANADIAN MIGRATION INSTITUTE Inc.USING THEIR BEST EFFORTS, KNOWLEDGE AND EXPERTISE IN CONNECTION WITH CLIENT(S)’S IMMIGRATION APPLICATION AND FURTHER, THE CLIENT ACKNOWLEDGES THAT ANY DECISION WITH RESPECT TO THE CLIENT’S APPLICATION IS WHOLLY WITHIN THE DISCRETION OF THE CANADIAN IMMIGRATION AUTHORITIES. THE CLIENT(S) ACKNOWLEDGES AND AGREES THAT THE FEES PAID TO “CANADIAN MIGRATION INSTITUTE Inc.” DO NOT GUARANTEE THE ACCEPTANCE OF THE CLIENT’S APPLICATION NOR HAVE ANY REPRESENTATIONS BEEN MADE BY “_CANADIAN MIGRATION INSTITUTE Inc.” THAT THE SUCCESS OF CLIENT’S APPLICATION IS GUARANTEED.

  1. Force Majeure

The RCICs failure to perform any term of this Retainer Agreement, as a result of conditions beyond his/her control such as, but not limited to, governmental restrictions or subsequent legislation, war, strikes, or acts of God, shall not be deemed a breach of this Agreement.

 

  1. Change Policy

 

The Client(s) acknowledge that if the RCIC is asked to act on the Client(s) behalf on matters other than those outlined above in this Agreement, or because of a material change in the Client(s) circumstances, or because of material facts not disclosed at the outset of the application, or because of a change in government legislation regarding the processing of immigration-related applications, the Agreement can be modified accordingly upon mutual agreement.

  1. Termination

This Agreement is considered terminated upon completion of tasks identified under section 2 of this agreement.

 

 

  1. Validation

The Client(s) acknowledge that they have read this Agreement, understand it, have obtained such independent legal advice as they deem appropriate, have sought translation and agree to be bound by its terms. 

The Client(s) acknowledge that they have requested that the Agreement be written in the English language; Les parties reconnaissent qu’elles ont exigé que ce qui précède soit rédigé en anglais. 

NOTE: ANY QUESTIONS OR CONCERNS AT ALL ABOUT THE TERMS OF THIS AGREEMENT SHOULD BE ADDRESSED TO “CANADIAN MIGRATION INSTITUTE INC.”  BEFORE COMPLETING THE PAYMENT.
