On February 12, 2025, Immigration, Refugees and Citizenship Canada (IRCC) updated the Immigration and Refugee Protection Regulations to further enhance the authority of border officers to cancel temporary resident documents. The key updates are as follows:
Upgrade of Cancellation Authority
Now, immigration and border services officers can cancel electronic travel authorizations (eTA) and temporary resident visas (TRV) based on specific circumstances. For example, cancellation may occur if:
- A person’s status or circumstances change, rendering them inadmissible or no longer eligible to hold the document (e.g., if the person provided false information, has a criminal record, or is deceased).
- An officer determines that the applicant will not leave Canada before the end of their authorized period.
- The document is lost, stolen, damaged, or abandoned.
Expansion of Cancellation Scope
In addition to the above, the new regulations allow officers to cancel documents (including TRV, eTA, work permits, and study permits) issued to people when:
- The holder becomes a permanent resident;
- The holder is deceased;
- The document was issued due to an administrative error.
Effective Date
All updated regulations officially came into effect on January 31, 2025.
